§ 35.099. PARTICIPANT TO FURNISH REQUIRED INFORMATION.

  • (A)

    Each participant will furnish to the Retirement Committee such information as the Committee considers necessary or desirable for the purpose of administering the plan, and the provisions of the plan respecting any payments thereunder are conditional upon the participant's furnishing promptly such true, full, and complete information as the Committee may request.

    (B)

    Each participant will submit proof of his age (and, in the case of his election of Section 35.097(E)(1)(b) or (c) of this subchapter, proof of the age of the joint pensioner selected by him) to the Committee at that time as required by the Committee. If proof of age is not submitted by a participant as required, the Committee may defer action on the participant's request for retirement benefits or rely on other available information to determine age. Any adjustment required by reason of lack of proof or misstatement of the age of persons entitled to benefits hereunder, by the participant or otherwise, will be in a manner as the Committee deems equitable.

    (C)

    Any notice or information which, according to the terms of the plan or the rules of the Committee, must be filed with the Committee shall be deemed so filed if addressed and either delivered in person or mailed to the Committee, in care of the City.
