§ 100.06. UNGUARDED EXCAVATIONS.

  • (A)

    Any excavation in the earth kept, maintained or permitted in an uncovered, unprotected, unfenced or otherwise dangerous or unsafe condition within the City is declared to be a public nuisance.

    (B)

    It shall be unlawful for any person to keep, maintain or permit a dangerous excavation in the earth uncovered, unprotected, unfenced or otherwise dangerous or unsafe condition within the City.

    (C)

    Nothing in this Section shall diminish or otherwise affect the power of the City to enjoin or abate any public nuisance in accordance with the laws of the State.
